La ONU Reclama El Fin Inmediato Del Régimen De Excepción.

Los expertos de la ONU Margaret Satterthwaite, Fionnuala Ní Aoláin, Morris Tidball-Binz. Expresaron consternación por la renovación del régimen de excepción en El Salvador. Y demandaron que las autoridades a garantizar que las personas no sean detenidas y encarceladas por la simple sospecha de pertenecer a pandillas, sin fundamentos legales legítimos en contra de los ciudadanos.

Expresaron preocupación por el respaldo que el Gobierno le da al concepto de “Delito fragante permanente” para favorecer las detenciones sin orden judicial de personas sospechosas de pertenecer a pandillas.

Según los datos oficiales, en septiembre de 2022 se habían registrado 58.000 detenciones bajo el nuevo régimen, de las cuales al menos 1.600 correspondían a menores de edad. Seis meses más tarde, el Decreto Ejecutivo N° 719 de marzo de 2023 informó que el número de detenidos había ascendido a “más de 67.000”. La información disponible sugiere que muchas de estas detenciones son ilegales y algunas equivalen a desapariciones forzadas de corta duración.

Según los informes, las audiencias iniciales, en las que los jueces revisan la legalidad sobre los cargos, se desarrollan en grupos de 500 personas.  Se ha reportado a la ONU que “los defensores públicos se les ha dado de tres a cuatro minutos para presentar los casos de 400 a 500 detenidos a la vez” también se le ha informado de juicios masivos.

Los expertos de la ONU aseguran que: “Estas medidas amenazan con criminalizar a las personas que viven en las zonas más empobrecidas y que han sido blanco de pandillas en el pasado”

Los 3 expertos aseguran que este tipo de interferencia en el sistema judicial de El Salvador corre el riesgo de limitar el acceso a la justicia paro los ciudadanos.
