Absuelven a un acusado de violación en Perú argumentando que la víctima llevaba ropa interior roja

Los magistrados encargados de juzgar una denuncia por violación en la ciudad peruana de Ica decidieron desestimar el caso incluyendo entre sus argumentos el hecho de que la denunciante llevaba puesta ropa interior roja en el momento de la agresión.

Tal como señala la prensa local, el tribunal, compuesto por dos mujeres y un hombre, llegó incluso a señalar que “la supuesta personalidad” de tipo tímido que presenta la denunciante “no guarda relación con la prenda íntima que utilizó el día de los hechos”.

Los jueces se refirieron además a una figura argumental denominada “la máxima de la experiencia” para concluir que “este tipo de atuendo interior femenino suele usarse en ocasiones especiales para momentos de intimidad”, por lo que se permitieron deducir que la denunciante estaba predispuesta a tener relaciones sexuales con el acusado.

En cualquier caso, los argumentos sostenidos en este dictamen han alertado a la Oficina de Control de la Magistratura (OCMA) que, según informó este lunes, iniciará una investigación preliminar del caso.

Por su parte, la Fiscalía ya ha solicitado la nulidad de la sentencia y la apertura de un nuevo juicio.

Hechos denunciados

Tal como consta en la denuncia policial, los hechos tuvieron lugar en enero de 2019, cuando la presunta víctima, de 20 años, aceptó acompañar al acusado, de 22, durante una gestión administrativa en una institución.

Tras ello, el hombre la habría invitado a un local de ocio donde bebieron alcohol. La denunciante señaló que el presunto agresor le instó a beber constantemente, y tras una única copa de vino, ella perdió el conocimiento. Al despertar, se encontró desvestida en una cama de la vivienda de su presunto agresor.

En el cuestionado fallo judicial del tribunal de Ica que ha absuelto al acusado, los magistrados mencionan que el testimonio de la denunciante presenta “omisiones”, mientras el imputado sostuvo que fue acusado “por venganza”.

Por su parte, el Ministerio de la Mujer y Poblaciones Vulnerables de Perú rechazó los argumentos vertidos en la sentencia, que a su juicio contienen “un razonamiento estereotipado y revictimizante“. Este departamento exigió además centrar los procesos judiciales en evidencias pertinentes y no en aspectos invasivos de la intimidad de la víctima.
