Cámara declara rebelde a Ana Ligia Mixco de Saca y programa audiencia preparatoria

La Cámara Primera de lo Civil de la Primera Sección del Centro, declaró en rebeldía a la ex primera dama Ana Ligia Mixco Sol de Saca, en el proceso que se le sigue por enriquecimiento ilícito, por un monto de 589 mil 808 mil dólares con 42 centavos.

La declaración de rebeldía se debe a que sus representantes legales no contestaron la demanda efectuado por la Fiscalía, pese a que el 28 de julio pasado fue legalmente emplazada.

En tal sentido la Cámara notificó a la ex primera dama que ha sido declarada rebelde y que solo volverá a ser notificada cuando termine el proceso de la demanda civil.

Asimismo los magistrados decidieron programar la audiencia preparatoria para el próximo 13 de diciembre a  partir de las nueve de la mañana y para dicha audiencia, han sido citados los  representantes de la Fiscalía y el abogado representante del ex mandatario.

En el caso específico de Saca, se le encontró un posible enriquecimiento ilegal por 3 millones 970 mil 013 dólares con 23 centavos; mientras que a su esposa se le detectó un posible enriquecimiento no justificado por 589 mil 808 dólares con 42 centavos, sumando entre ambos 4 millones 559 mil 821 dólares con 65 centavos.

De tal manera que la audiencia preparatoria del próximo 13 de diciembre será solo para encausar a Saca y su esposa. En dicha audiencia las partes, de los demandados y la Fiscalía, presentarán las pruebas para que jurídicamente los magistrados valoren cuales aceptan o rechazan.

Posterior a la audiencia preparatoria se realiza la audiencia probatoria, donde los magistrados valorarán el desfiles de pruebas, para finalmente dar su fallo, el cual puede se en el sentido de declarar ha lugar la responsabilidad de enriquecimiento ilícito o declara no  ha lugar. En caso de ser encontrado ha lugar, los demandados deberán devolver al estado lo mal habido y quedarán inhabilitados automáticamente o para buscar o ejercer cualquier cargo público durante diez años. Todo fallo de la Cámara está sujeto a ser apeldado por cualquiera de las partes.
