Benito Lara y su familia tendrá que devolver más de 100 mil dólares al estado

Benito Lara exdiputado de la Asamblea Legislativa por el FMLN del 2009 al 2014 y ex Ministro de Justicia y Seguridad del 2014 al 2017, condenado por enriquecimiento ilícito.

La Cámara Primera de lo Civil de la Primera Sección del Centro de San Salvador condenó ayer al exdiputado del FMLN y exministro de Justicia y Seguridad, Benito Lara, y su familia por enriquecimiento ilícito de $109,555.87.

Según resolvió la Cámara, lo enriquecido corresponde en el periodo del 2009 al 2014, cuando Lara fungió como diputado de la Asamblea Legislativa, así mismo, en el periodo del 2014 y 2017 cuando era ministro de Justicia y Seguridad.

“Se determinó que el señor Benito Lara tendrá que devolver al Estado de El Salvador la cantidad de $39,253.23, la señora Ana Emilia de Lara la cantidad de $2,000 y su hija, Ana Briseyda Lara se le condenó a restituir la cantidad de $68,302.64 haciendo un total de $109,555.87”, informó la fiscal del caso.

Tanto Benito Lara como su grupo familiar fueron inhabilitados para ejercer cargos públicos por 10 años.

El monto cuestionado en un principio era de $131,571.67, sin embargo, en la resolución mixta que dio la Cámara, estableció que se tuvo por justificado $92,000, a través de las pericias contables.

Inconformes.

Ante esa sentencia, el abogado defensor de Benito Lara, Marvin Flores, aseguró que están inconformes, ya que el criterio de la Cámara fue condenar, aún existiendo pericias que establecen que no había enriquecimiento ilícito.

“Habíamos aportado prueba documental, pericial y testimonial, pero adicional a eso, la misma pericia financiera de la Fiscalía, que es tanto como la nuestra como la de ellos, eran coincidentes en relación que no se podía establecer que había enriquecimiento ilícito ni aumento patrimonial injustificado”, afirmó Flores.

Aseguró que el fallo es “contradictorio”, y por tal razón, una vez tengan la sentencia por escrito, interpondrán los recursos de apelación para revocar esa decisión.

La Fiscalía inició la demanda por 14 irregularidades del primer periodo como diputado, desde el 1 de mayo de 2009 al 30 de mayo de 2012, por $33,989.33. En el segundo periodo, del 1 de mayo de 2012 al 31 de mayo de 2014, por dos irregularidades de $16,900 por la adquisición de vehículo y un resultado negativo de su ingreso (ganancia) y egreso por $53,751.11.
