¿Shakira puede sufrir repercusiones legales por su último éxito con Bizarrap?

En los últimos días se ha vuelto tendencia y tema de conservación el nuevo éxito de Shakira junto a Bizarrap llamado “Pa´ tipos como tu” por su ruptura con el jugador de fútbol Piqué. No obstante, además de generar conversión, también ha crecido la duda sobre algunos aspectos y repercusiones legales que esto puede acompañar a la canción.

A pesar de 12 años de relación y 2 hijos de por medio, esta relación llegó a su fin el año pasado en el mes de junio, donde declaró que “lamentamos confirmar que nos estamos separando, por el bienestar de nuestros hijos pedimos privacidad”. Sin embargo, es uno de los principales temas más hablados a nivel digital.

Y es que debido a su último éxito por Sessions Vol. 53, tema en colaboración con el productor argentino Bizarrap, está generando mucha controversia debido a las referencias señaladas por la colombiana, específicamente a marcas como Ferrari, Twingo, Rolex y Casio.

Pero realmente ¿Esto puede generar repercusiones legales contra su último éxito?

Un creativo digital explica que proceder a una demanda de este estilo puede ser complicado, pues no es del todo sencillo cuantificar cuál fue el daño por ofensas a la imagen, sobre todo en la manera en como se desarrolló, debido a que es bastante común que los artistas utilicen inspiraciones autobiográficas para generar sus contenidos.

Además, de ejercer su derecho de libre liberta de expresión, garantía que es considerada aceptable ante una democracia y por la Corte Interamericana de Derechos Humanos.

No obstante, podría ser considerado como un tema de difamación, delito en control del honor de una persona, aunque esta pueda ser encubierta o tomada de manera simplista. Aunque esto no pueda ser tomado en cuenta debido a lo anteriormente mencionado que es importante conocer bien el contexto por el cuál se genero y quién es la parte afectada.
