Shakira irá a juicio en España por presunta evasión fiscal

La cantante de pop colombiana Shakira no llegó a un acuerdo con la Fiscalía e irá a juicio en España insistiendo en su inocencia, según un comunicado difundido por su equipo de relaciones públicas.

“Shakira y su equipo consideran que este caso constituye una total violación de sus derechos, ya que siempre ha mostrado un comportamiento intachable, como persona y contribuyente, y una total disposición a resolver cualquier desacuerdo desde el principio, incluso antes del proceso penal”, dice el comunicado.

En julio de 2021, un juez de un tribunal cercano a Barcelona dictaminó que la cantante colombiana podía ser juzgada por una presunta evasión fiscal de 14,5 millones de euros (US$ 17 millones) en España. Hay “pruebas suficientes” para celebrar un juicio por la presunta evasión de impuestos de Shakira en los años 2012, 2013 y 2014, dijo el magistrado instructor en un fallo, que obtuvo CNN.

El juez Marco Jesús Juberías argumentó que Shakira vivió más de 200 días en España en cada uno de esos tres años, lo que la hace responsable de pagar impuestos en el país. Juberias dijo que en la investigación hasta ahora la agencia tributaria de España y los abogados de Shakira han discutido sobre el significado de “residencia principal”.

El código fiscal español dice que cualquier persona que resida en España durante al menos seis meses y un día —o 183 días— en un año determinado está obligada a pagar impuestos en España, dijo a CNN la asesora fiscal de Madrid, Beatriz García.

Los medios de comunicación españoles dijeron en su momento que el equipo de Shakira argumentaba que su residencia principal estaba en las Bahamas. Pero los medios locales también habían informado que tiene una casa en el área de Barcelona, con su ahora expareja, el defensa de fútbol del FC Barcelona Gerard Piqué, con quien tiene dos hijos. Piqué y Shakira anunciaron su separación en junio de este año.

El juez, en el juzgado de Esplugas de Llobregat, argumentó que Shakira y un asesor financiero, también nombrado en la sentencia, utilizaron una serie de empresas en paraísos fiscales para intentar ocultar las fuentes de sus ingresos durante esos años.
